Terms & Conditions
1.1 The Fan Team Product intends to involve SLT fans in the decision making of a team. The decisions can directly affect the performance of the team, from selecting the team members as part of the draft, to deciding who will take the short chute. As part of the ownership, SLT fans can get exclusive opportunities to get up close and personal with the athletes and managers.
1.2 The present Terms and Conditions (T&C) govern all legal relationships between the subscriber to the Fan Team Product (Subscriber or You) and Super League Triathlon (SLT) in relation to the Fan Team Product, unless the applicability of the T&C is excluded or restricted by law, regulations or written agreement.
2.1 “Account” means the user account on the website fans.superleaguetriathlon.com that You use to access the Fan Team Product.
2.2 “Event” means the Super League Triathlon Championship Series to which You have access as part of your Fan Team Product Package.
2.3 “Fan Team Product Package” means the relevant package (i.e., Bronze, Silver, Gold, Platinum or Diamond Package) that You selected in the registration form.
2.4 “Merchandise” means any promotional goods listed in the registration form as part of your Fan Team Product Package.
2.5 “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party.
3. Acceptance and payment of the subscription
3.1 Any request for a subscription will automatically constitute Your full acceptance of these T&C.
3.2 The annual subscription fee mentioned in the registration form for the selected Fan Team Product Package will be charged to your Payment Method. Additional purchases can be made through the website and will be charged separately.
4.1 All subscriptions are nominative and non-transferrable.
4.2 You must be 18 years or older to subscribe. Minors can only subscribe to a Fan Team Product Package and use the Fan Team Product with parental consent.
4.3 SLT may change its Fan Team Product Packages and their price of from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to You.
5.1 You may withdraw Your subscription and be refunded in full up to 14 days after registering Your Account, after which time Your subscription fee will not be refunded.
5.2 Notice of withdrawal from the event must be communicated by emailing firstname.lastname@example.org stating clearly the desire to withdraw and putting the word WITHDRAWAL in the subject line of the email. Withdrawals will not be accepted by telephone.
5.3 Your right of withdrawal is lost once You use the Fan Team Product, e.g. by voting on decisions or attending an Event. The subscriber will acknowledge via a tick box that sits after an explanation that the subscribers right of withdrawal cannot be exercised anymore after the subscriber casts their first vote or otherwise uses the Product.
6. Decision making
6.1 The Fan Team Product intends to involve SLT fans in the decision making of Team Cheetahs as if they were the team owners. Your decisions should always be within the rules and spirit of the sport and of SLT. Decisions can be made through the website or any other platform designated by SLT. The Team Cheetah manager is obliged to take into account the decisions made through the Fan Team Product. Nonetheless, SLT, the managers, coaches, any other stakeholders or the athletes themselves are not bound to follow such decisions if these decisions are not in the best interest of the athletes and will not be held liable if they do not follow Your decision. The best interest of the athletes prevails.
6.2 Unless explicitly stated in these T&C, no licence ownership rights or title to SLT, Team Cheetahs or any other affiliated brand can be derived from Your subscription.
7.1 Depending on the Fan Team Product Package chosen, You will be invited to attend Events.
7.2 Should an Event not be conducted or only partially conducted or be annulled for any reason beyond the SLT’s reasonable control (Force Majeure Events), SLT will be excused from performance and You will not be entitled to any refund of the entry fee or compensation for any other losses, such as travelling or accommodation expenses. Force Majeure Events include unforeseen circumstances such as civil riots, governmental restrictions on foreign travel, union actions, natural disaster, pandemic, strike, lockout, labour or civil disturbance or restriction, fire, earthquakes, cyclones, floods, epidemics, international or national embargoes or blockades, acts of war or terrorism, sabotage, government decisions or administrative injunctions, including without limitation possible restrictions, recommendations, guidelines or other measures imposed or recommended to be taken by (health) authorities. It is expressly agreed that the unforseeability condition does not have to be fulfilled for any health related event (such as for instance coronavirus related pandemic, another pandemic or epidemic and/or quarantine measures) to qualify as a Force Majeure Event. All claims will be forfeit for no-shows.
7.3 Should You not be able to attend an Event, You must inform SLT at least 2 weeks before the date of the Event. As far as reasonably possible, a new invitation for a different Event will be extended.
7.4 SLT reserves the right to make changes to its programme, including changing the dates, format or start times of its Events. In the event of a change, You will be notified with as much notice as reasonably practicable. Changes made within the scope of this clause shall not give You the right to claim a refund.
7.5 Additional terms and conditions, including a late cancellation fee, may apply depending on the Event. If your Fan Team Product Package includes travel arrangements, these shall be governed by the terms and conditions of the travel agency engaged by SLT. SLT shall not extend any cancellation rights or allow changes beyond what is permitted by the travel agency terms and conditions.
8. Merchandise and promotions
8.1 SLT can provide you with Merchandise depending on your Fan Team Product Package. Delivery times that are indicated on our website are indicative and not binding on SLT. In any case, SLT will take reasonable measures to ensure that Merchandise will be delivered to the subscriber within the indicated time period. If you have any questions about your Merchandise, please contact email@example.com. Merchandise orders will be processed and fulfilled by our suppliers. You acknowledge that SLT shall pass on your order details, including your name and contact details, to such suppliers in order to fulfil the order.
8.2 The value of Merchandise that is not supplied will be refunded.
8.3 SLT may from time to time offer special promotional offers, plans or memberships. Offer eligibility is determined by SLT at its sole discretion, and SLT reserves the right to revoke an offer and put Your account on hold if it determines You are not eligible. The eligibility requirements and other limitations and conditions will be disclosed when You sign-up for the offer or in other communications made available to You.
9. Duration and termination
9.1 Your subscription is annual and begins as soon as your initial payment is processed. Your subscription will automatically renew annually until it is cancelled. SLT will notify You of the renewal one month before your subscription is renewed. You authorise us to store your payment method(s) and to automatically charge your payment method(s) each year until you cancel.
9.2 You can terminate your subscription at any time. You will continue to have access your Fan Team Product Package until the end of your billing period. Payments are non-refundable and SLT does not provide refunds or credits for any partial membership periods or unused Fan Team Product Package content. If You terminate your subscription, your account will automatically close at the end of your current billing period.
9.3 SLT can, immediately and without notice, block, restrict, suspend or terminate your Account with no compensation or reimbursement, if, in SLT’s sole opinion, You are in breach of any of the provisions of these T&C, any other policy of SLT or if your behaviour damages SLT’s reputation or its business interests.
10. Suspension of Your Account
10.1 SLT reserves the right to suspend access to Your Account for maintenance, repairs or to make enhancements or adjustments to the Fan Team Product. SLT will to the extent reasonably possible notify You in advance of such suspension.
10.2 The service relies on infrastructure, parts of which are run by third parties, and such service is not without risk of interruptions. Hence, disruptions to the service may occur without prior notification. Interruptions can be caused, inter alia, by technical incidents or Force Majeure events. If You are partially or wholly denied access to Your Account, SLT will upon request and to the extent reasonable notify You of the reasons for such denial of access.
11. 1SLT cannot be held liable for any loss caused in whole or in part by Your misuse of your Account, whether such misuse is intentional or not.
11.2 To the full extent permitted by the law, SLT’s liability for a breach of any guarantee, condition or warranty is limited to restoring your Account or repayment of the costs of Your subscription. SLT shall never be liable for indirect or consequential damages.
11.3 SLT cannot be held liable if You are not able to access your Account for any reason. SLT will provide reasonable efforts to assist You in solving access issues.
12. Passwords and Account Access
12.1 You are solely responsible for any activity that occurs through Your Account. To maintain control over Your Account and to prevent anyone from accessing Your Account (which would include information on viewing history for the account), You should maintain control over the devices that are used to access the Fan Team Product and keep your Account details and Payment Method confidential. You are responsible for updating and maintaining the accuracy of the information You provide to SLT relating to Your Account.
12.2 SLT is not liable for any loss or damages caused by your failure to maintain the confidentiality of your Account credentials. Please contact us at firstname.lastname@example.org if you discover or suspect any security breach related to Your Account. SLT can terminate Your Account or place your Account on hold in order to protect You, SLT or SLT partners from identity theft or other fraudulent activity.
13. Intellectual Property
13.1 You acknowledge that any intellectual property rights including graphics, logos, designs or icons relating to the Account or the Fan Team Product remain the property of SLT or SLT’s licensors. Nothing in these T&C constitutes an assignment of any intellectual property rights in the Account (or any improvements made to the Account) to You.
14. Privacy and data protection
15.1 Changes to the T&C
SLT may, from time to time, change these T&C. We will notify You at least 30 days before such changes apply to You. Your continued use of Your Account after such period shall be deemed to constitute acceptance of any such change.
If any provision in these T&C shall be held to be illegal, invalid or unenforceable, in whole or in part, under any applicable law, that provision shall be deemed not to form part of these T&C, and the legality, validity or enforceability of the remainder of these T&C shall not be affected.
15.3 Governing law
These T&C shall be governed by, and construed in accordance with, the laws of England and Wales.
Any dispute relating to these T&C that cannot be solved amicably shall be subject to the exclusive jurisdiction of the competent courts of England and Wales. The Parties agree not to invoke any legal rules that might provide for the law or courts of another jurisdiction to be declared competent.
